1. Acceptance of Terms

These Terms of Use govern your access to and use of cardivela.com and Cardivela products, downloads, free tools, digital tools, content and related services.

By accessing or using the website, using a free Cardivela tool, or purchasing or using a Cardivela product, you agree to these Terms and any policies referenced in them.

If you do not agree, do not use the website or Cardivela products or services.

2. Eligibility

You must be legally able to enter into an agreement in your jurisdiction to make purchases or create any account offered through the site.

If you use Cardivela on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Products & Services

Cardivela offers wellness-related organizational and educational resources, which may include digital trackers, free browser-based tools, printable journals, recipe collections, downloadable files, educational resources and other content.

Some Cardivela tools are offered free of charge, while others require purchase.

Features, availability, pricing, supported devices, product descriptions and functionality may change from time to time.

4. Free Tools & Local Storage

Cardivela may provide free browser-based tools, including the Cardivela Free Blood Pressure Tracker. These tools may be available without a purchase or user account.

Because information in the Free Blood Pressure Tracker is stored locally in the browser, Cardivela cannot guarantee permanent storage or recovery of that information.

Locally saved information may be lost if, for example:

• browser or website storage is cleared;
• cookies or site data are deleted;
• the browser is reset or removed;
• private or incognito browsing is used;
• a device is lost, damaged, replaced or reset;
• a different browser or device is used; or
• browser, operating-system or storage behavior changes.

You are responsible for preserving any information that is important to you outside of a locally stored Cardivela tool.

Cardivela may modify, suspend or discontinue free tools or features when reasonably necessary. We do not guarantee that a free tool will remain available indefinitely or operate without interruption on every browser, operating system or device.

5. No Medical Advice

Blood pressure categories, labels, alerts, warnings, educational ranges or similar information displayed by a Cardivela tool are provided for informational and organizational purposes only.

They do not diagnose a medical condition, determine your individual health status, prescribe treatment or determine whether a medication should be started, stopped or changed.

Do not use Cardivela to make medication changes or to delay or replace professional medical care.

6. Digital Product License

Unless a product page states otherwise, Cardivela digital products are licensed to the purchaser for personal, non-commercial use. Your purchase does not transfer ownership of Cardivela intellectual property.

You may not resell, redistribute, sublicense, upload purchased files for public access, share purchased files with others, remove ownership notices, reproduce products for commercial use, or create derivative products for resale without written permission.

7. Orders & Payment

You agree to provide accurate order and billing information. Prices and taxes, when applicable, are shown during checkout.

We may refuse or cancel an order when reasonably necessary because of pricing errors, suspected fraud, unauthorized activity, technical problems or product availability.

8. Refunds

Refunds for purchased Cardivela products are governed by the Cardivela Refund Policy . Purchases made through a third-party marketplace or retailer may also be subject to that seller’s refund and return rules.

Free Cardivela tools do not involve a purchase and therefore are not eligible for a monetary refund.

9. Accounts & Access

If Cardivela offers an account or customer-access area, you are responsible for keeping login credentials confidential and for activity occurring through your account.

Notify us if you believe your account has been accessed without authorization.

Some free Cardivela tools do not require an account. Use of a free tool does not create a customer account or guarantee cloud storage, synchronization or recovery of data.

10. Prohibited Use

You may not use the website, free tools or products to:

• violate applicable law or the rights of another person;
• interfere with website security, availability or normal operation;
• attempt unauthorized access to accounts, systems or data;
• copy, scrape, reverse engineer or systematically extract site content except where permitted by law;
• upload malicious code or engage in fraudulent, abusive or deceptive activity;
• attempt to bypass access controls, purchase requirements or restrictions protecting paid Cardivela products; or
• use Cardivela content or products in a way that infringes intellectual-property rights.

11. Intellectual Property

Cardivela names, branding, website content, original text, designs, graphics, product layouts, downloads and software are owned by Cardivela or used with permission and are protected by applicable intellectual-property laws.

Nothing in these Terms grants you ownership of those materials.

12. Third-Party Services

The website may contain links to or integrations with third-party services.

Cardivela is not responsible for third-party websites, services, content, availability, policies or transactions. Your use of third-party services is subject to their terms.

13. Disclaimers

To the fullest extent permitted by law, the website, free tools and Cardivela products are provided on an “as is” and “as available” basis.

We do not guarantee that the website or tools will be uninterrupted, error-free, compatible with every device or browser, or continuously available.

Cardivela does not guarantee the permanent preservation or recovery of information stored locally in a user’s browser or device.

We do not guarantee that any wellness result, health outcome or specific result will occur from use of Cardivela products or tools.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Cardivela will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or business opportunities arising from or related to use of the website, free tools or products.

This includes, to the extent permitted by law, loss of information stored locally in a browser or device.

Where liability cannot legally be excluded, it will be limited to the extent permitted by law.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold Cardivela harmless from claims, losses, liabilities and expenses arising from your misuse of the website or products, your violation of these Terms, or your infringement of another person’s rights.

16. Termination

We may restrict or terminate access to website features, tools or services when reasonably necessary to protect Cardivela, users, systems or legal rights, including for a material violation of these Terms.

17. Applicable Law

These Terms are governed by applicable law. Any mandatory consumer protections that apply to you remain unaffected.

18. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with a new effective date.

Continued use after changes become effective constitutes acceptance to the extent permitted by law.
